1. Important information and who we are

Sage Mobile Limited ("we", "us", or "our") is the controller responsible for the personal data we collect and use about you. Section 9 below provides details on how to contact us.

This privacy notice tells you about the types of information we collect about you when you visit our website (www.sagemobile.com), purchase our products, and when your child uses our products and services. It also outlines how we use that information and how we may share it.

This privacy notice is directed to you as the parent, guardian or other responsible adult using our site and purchasing our products and services to be used by children. We provide information about how we will process the personal data of you, as the purchaser, and your child as the user of the device.

2. Data we collect and use about you

Personal data, or personal information, means any information about an individual from which that person can be identified.

We have grouped together the different types of personal data we collect and use about you and your child based on how and when the data is collected. When we refer to your personal data in this privacy notice, this includes the personal data of your child when the context requires. If you do not provide your personal data to us, we will not be able to provide our services to you or your child. We do not carry out any automated decision-making (using personal data that we collect through the website or our products and services) that has a legal effect or similarly significant effect on individuals.

When you make a purchase and create an account:

  • Identity Data including full name and date of birth.
  • Contact Data including billing address, delivery address, email address and telephone numbers.
  • Verification Data including Identity Data, Contact Data, a headshot taken using a webcam, and a photo identification document.
  • Account Information including email address, password, and profile preferences order history.
  • Family Data including basic Identity Data regarding your child.
  • Financial Data including bank account, payment card details, details about payments to and from you and other details of products and services you have purchased from us. If you apply for financial aid you may be required to provide information regarding your income.
  • Marketing and Communications Data including your preferences in receiving marketing from us and our third parties, your communication preferences, the communications you send to us, or other users.

When you use our products:

  • Device Information including Device ID, IP address, operating system, browser type, SIM or phone number (if applicable).
  • Profile Data including your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses.
  • Usage Data including app and device usage, parental controls, and monitoring preferences.
  • Child Profile Data including names or nicknames, age or birth year, and screen time settings.

When you communicate with us and engage with our content:

  • Communications Data including communications you send to us, such as customer service inquiries, product reviews and other feedback regarding our products, services and the website.
  • Forums and Content Data including comments and thoughts you share on our public forums, such as questions, forum posts, personal messages, ratings and peer-to-peer feedback, responses to in-video quizzes, standalone quizzes, exams, and surveys.

When you browse our website we will automatically collect:

  • Technical Data including internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access our website.

If you are a child using our product and services, we may also collect certain personal data about you from your parent/guardian entering into the Terms of Use with us.

5. Disclosing your personal data

Support and technical assistance are provided to us by our group company, Techless Inc, so we share your personal data with Techless Inc in order to provide our services.

When using your personal data, depending on the type of personal data and the purposes of processing, we may disclose it to:

  • [name of company] who is licensed under UK consumer hire law to enter into regulated consumer hire agreements as owner;
  • third party service providers, subcontractors, agents and other organisations who provide services to us in connection with the operation of our business or to you on our behalf such as IT and cloud hosting providers, administrative services, and ID verification;
  • our professional advisers including lawyers, bankers, auditors, accountants and insurers;
  • third parties where we choose to sell, transfer or merge parts of our business or our services;
  • regulators who regulate how we operate; and
  • any person or organisation to whom disclosure is required in our reasonable discretion or where such disclosure is permitted under applicable laws and regulations.

Where third party service providers act as processors on our behalf, we do not allow them to use your personal data for their own purposes and only permit them to process your personal data for specified purposes in accordance with our instructions.

Legacy Portfolio and Apple
In order to provide the services designed in the product, we rely on the software and hardware owned and operated by Legacy Portfolio and Apple.

Legacy Portfolio provides the software through Guardian Lock. Guardian Lock prevents bypassing the locked app store access, factory reset prevention and operates the safety features embedded in messaging platforms.

The hardware of the product is an iPhone manufactured by Apple. Applications and Apple Care services are provided by Apple. Apple therefore also processes personal data relating to you and your child to provide these services in accordance with their privacy policy. 6. International data transfers

We transfer your personal data to third parties in the US and to other parties outside of the UK / European Economic Area (EEA). Where we transfer your personal data outside of the UK / EEA, we ensure a similar degree of protection is afforded to it by ensuring that at least one of the following safeguards is implemented:

  • We transfer your personal data to countries that have been deemed to provide an adequate level of protection by the UK Secretary of State and/or the European Commission.
  • We implement certain standard contractual clauses with the recipients of your personal data to safeguard transfers to countries outside of the UK / EEA.
  • We rely on alternative measures that are valid and appropriate at the time including where you have explicitly consented to the proposed transfer or the transfer is necessary in an emergency situation.

7. Data retention

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for. We may retain your personal data for a longer period in the event that we need to use it to comply with a legal obligation, a prospect of litigation, concerns over relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and applicable laws regarding data retention, such as the retention of records applicable legal, regulatory and tax, accounting or other requirements.

Generally, we will only retain personal data about our users for 7 years from the date you close your account or following 6/12 months of inactivity. Where you use our website and services without an account we will generally only retain that personal data for a period of 6/12 months from our last interaction with you.

In some circumstances you can ask us to delete your personal data (see your rights below).

In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

You have a number of rights in relation to your personal data under data protection law.
